Acting for this multinational resources company, headquartered in India, in relation to disputes with John Holland Pty Ltd arising out of the expansion of the Abbot Point Coal Terminal in North Queensland.
RACQ
Acting for RACQ in successfully defending various Federal Court claims by contractors arising out of a restructuring of its network, involving complex legal arguments including alleged unconscionability and the application of the Australian Consumer Law.
State MP
Acting for the then leader of the opposition and former Health Minister in a Commission of Inquiry involving the production of a substantial amount of documentation, advice concerning oral evidence and significant matters of parliamentary privilege.
Chamberlain Inc
Advising an employee in the finance team that defrauded the US Corporation’s Australian subsidiary. We conducted a fraud investigation and a civil and criminal prosecution in respect of the large defalcation of funds.
Multinational Corporate
Acting in two related judicial reviews concerning the legality of decisions to reassess royalty liabilities. As well as having significant economic ramifications, the reviews break new ground in how royalties are assessed and levied.
Lindsay Australia Limited
Acting for Lindsay Australia Limited, defending the company in the Supreme Court of Victoria proceedings commenced by Orora Limited concerning alleged breaches of an interstate distribution agreement involving a significant damages claim and a number of interlocutory applications.
GBST Holdings Limited
Acting for the defendant in proceedings commenced by its former Managing Director and CEO. The dispute concerned non-payment of incentives and termination payments and a counterclaim involving allegations of misuse of information and a claim for unauthorised profits.
Sandvik Mining Construction Australia
Acting for Sandvik in defending claims arising from the liquidation of a third-party supplier, including the investigation of potentially fraudulent activity by the directors of the supplier and related entities.
Department of Transport and Main Roads
Acting for the Department in advising and successfully defending proceedings (in the Supreme Court and High Court) by a landowner in relation to a proposed compulsory land acquisition.
