Simon is an experienced litigator and an accredited specialist in commercial litigation. He has acted in relation to a broad range of disputes since his admission in 2002. Over the past ten years, Simon has practised exclusively in estate litigation, estate administration, estate planning and commercial litigation.
He provides support to a range of clients from individuals, charities, professional advisors, company directors and corporations.
Simon has extensive experience advising clients in relation to disputed estates, including contested probate applications, will construction and rectification applications, claims for family provision, insolvent estates and the payment of superannuation death benefits.
He also advises clients in relation to estate planning, including business succession planning, and in relation to the administration of estates.
Acting in defence of Supreme Court proceedings commenced by various members of a self managed super fund claiming unpaid benefits.
Defending the directors of a not-for-profit company against claims for equitable compensation of in excess of $10 million sought on the basis of alleged accessorial liability arising from the directors’ purported participation in breaches of terms of a charitable trust.
Contested probate application
Acting in relation to a contested probate application involving claims of undue influence, lack of knowledge and approval and lack of testamentary capacity.
Will construction and rectification proceedings
Acting in relation to will construction and will rectification proceedings concerning the terms of a testamentary trust.
Advising the executor of an insolvent estate with in excess of 30 unsecured creditors and involving issues including the protection of life insurance proceeds from the claims of creditors and complex creditor claims by former business partners of the deceased.
