The Defects Bond Scheme has created a number of challenges for the development market in New South Wales since it came into effect earlier this year (applying to contracts entered into on and from 1 January 2018). Some of these challenges include how contracts need to be updated to address the new regime and what parties need to do to ensure full compliance with the new regime.
