About Carlo
Carlo Garofali is a Special Counsel in our Construction and Infrastructure group (Back End), with a particular focus on construction claims dispute resolution with 25 years of experience in the construction industry as a professional civil engineer and 10 years of experience in construction law.
Carlo has experience acting for principals, contractors and subcontractors on various airport, road and tunnel infrastructure projects as well as train upgrade projects. He has also worked with various owners and contractors involved in commercial, industrial and residential building disputes including the owners of Mascot Towers.
He advises clients primarily on contentious matters, including:
- all forms of payment disputes, including in connection with claims for variations, latent conditions, extensions of time, delay costs, and disruption costs;
- disputes in relation to defective works; and
- the operation of the various Security of Payment regimes across Australia.
He also assists clients to manage or avoid disputes through contract administration and risk-management. If a formal dispute arises, he acts for clients in a range of dispute resolution forums, including litigation, arbitration, expert determination, and in adjudication proceedings under the Security of Payment regimes across Australia.
Carlo is also regarded as an expert in the field of concrete construction formwork and scaffolding, and is currently a committee member of the NSW Branch of the Concrete Institute of Australia. He is often asked to deliver presentations to CIA and to various other construction law forums.
