RACQ Warranty repairs program
RACQ is Queensland’s largest member organisation, providing a range of services and benefits to members. As one such benefit, it accredits motor repairers as ‘RACQ preferred’. These are often independent repairers with a local presence only.
RACQ wanted to implement a program where members who had had a repair done at a ‘RACQ preferred’ repairer could get any issues that arise during the repair warranty period fixed at any ‘RACQ preferred’ provider anywhere in Queensland, free of charge. That provider would then charge the original repairer a flat labour charge.
McCullough Robertson advised RACQ on a number of competition law issues raised by the proposal, including possible price fixing.
We assisted RACQ to obtain ACCC authorisation so RACQ could implement the program without risking prosecution.
