The McCullough Robertson Fashion Industry Group's clients are drawn from all sectors of the fashion industry and include designers, manufacturers, distributors, wholesalers, retailers and hairdressers.  We represent both local and overseas businesses and advise on a range of issues from lodgement of a single trade mark or retail shop lease through to complex brand management strategies and international trade.

Our lawyers have extensive experience in the management of trade marks, including searching, preparing applications for registration, opposition, renewal, transfers, licences, sponsorship, franchising agreements and prosecuting intellectual property infringement proceedings. We can also register trade marks overseas.

Some fashion designers may no longer be able to rely upon the benefit of copyright protection in their designs.  The Fashion Industry Group is able to offer advice and innovative solutions to this problem based on the implications of the Designs Act 2003.

The Fashion Industry Group also offers anti-counterfeiting services.  We are able to help implement anti-counterfeiting and anti-piracy strategies by advising on the direction of marketing campaigns, handling civil actions in the Federal and Supreme Court, obtaining Anton Pillar orders, dealing with customs and working with the media to publicise anti piracy campaigns.

Our lawyers also have experience in vetting proposed advertisements in order to minimise the risk of infringing third parties’ intellectual property rights or breaching the Trade Practices Act.
