Contract preparation - moratorium period for agents in the legal industry

The Queensland Government has provided a moratorium period Legal Profession (Transitional) Regulation 2007 (Qld) from 1 July 2007 to 30 June 2008 for PAMDA licensees and their employees who have or continue to prepare or assist in the preparation of contracts for another person.

PAMDA licensees and their employees are not considered to have engaged in legal practice if the activity:

  • occurred between 1 July 2007 and 30 June 2008 [1], and
  • was the preparation or assisting in preparing a contract by a real estate agent for another person [2], or
  • ancillary or incidental to the point above and part of the ordinary course of business undertaken generally by a real estate agent [3].

This moratorium period expires on 30 June 2008. Mark this date in your diaries now.
